SMS Consent & Compliance
What you and your customers need to know before BusinessBuddy sends a text.
Consent first
Get prior express consent from every customer before texting them.
Reply STOP
Customers can unsubscribe at any time by replying STOP.
Rates may apply
Standard messaging and data rates may apply for recipients.
Your responsibilities
BusinessBuddy is a messaging tool — you are the sender. Before you import a customer or enable an automation that texts them, you must have prior express consentfrom that person to receive SMS from your business. This typically means a clear opt-in (a checkbox at booking, a signed intake form, or an explicit verbal/written agreement).
Required disclosures in your messages
The first SMS to any new recipient (and at reasonable intervals after) should include:
- Your business name, so the recipient knows who is messaging.
- Instructions to opt out — typically "Reply STOP to unsubscribe".
- A note that "Msg & data rates may apply".
- Optionally "Reply HELP for help" with a contact method.
BusinessBuddy's default SMS templates include this language. If you customize templates, keep these disclosures intact.
Opt-out handling
When a recipient replies STOP, UNSUBSCRIBE, CANCEL, END, or QUIT, the carrier automatically suppresses further messages from that sender to that number. BusinessBuddy also flags the contact internally so future automations skip them. Do not attempt to text a number that has opted out.
Frequency & content
Only send messages relevant to the relationship the customer opted in for (appointment reminders, review requests, thank-yous). Do not send unrelated marketing blasts without a separate marketing opt-in.
Applicable law
In the United States, SMS marketing is regulated by the TCPA and CTIA guidelines. Other jurisdictions have their own rules (e.g. CASL in Canada, GDPR/PECR in the EU/UK). You are responsible for complying with the rules that apply to your business and your customers' locations.
